Terms & Conditions

Welcome to Comfort Matters Air & Mechanical LLC ("Comfort Matters," "we," "our," or "us"). By accessing our website, requesting service, approving an estimate, scheduling an appointment, or purchasing products or services from us, you agree to these Terms & Conditions.


1. Services

Comfort Matters Air & Mechanical LLC provides residential and commercial HVAC installation, replacement, repair, maintenance, indoor air quality, refrigeration, and related mechanical services throughout Florida.

***All services are subject to technician availability, parts availability, weather conditions, and applicable permitting requirements.***


2. Estimates

All estimates are valid for thirty (30) days unless otherwise stated.

Pricing is based on the information available at the time of inspection. Hidden conditions discovered after work begins may require additional labor or materials, which will be presented to the customer for approval before proceeding.


3. Scheduling

  • Appointments are scheduled within agreed service windows.
  • Customers are responsible for providing safe and unobstructed access to equipment.
  • Failure to provide access may result in a trip charge or rescheduling fee.


4. Payment Terms

Unless otherwise agreed in writing:

  • Residential service is due upon completion.
  • Commercial invoices are due according to the payment terms listed on the invoice.
  • Installation projects may require deposits before work begins.


Accepted payment methods include:

  • ACH
  • Check (Returned checks are subject to applicable bank fees and collection costs.)
  • Credit Card (Credit card payments are subject to a 3% processing fee.)

***Past due invoices may accrue interest at the maximum rate permitted under Florida law.***


5. Deposits

Special-order equipment and custom materials may require a non-refundable deposit. Deposit requirements will be identified on the estimate.


6. Permits

Where required, Comfort Matters will obtain permits unless otherwise stated in writing. Permit fees are separate unless specifically included in the proposal.

***Customers agree to provide any documentation required by the permitting authority, including Notices of Commencement when applicable.***


7. Warranty

Manufacturer warranties apply only to equipment and parts covered by the manufacturer.

Comfort Matters provides a one-year workmanship warranty on qualifying installations unless otherwise stated.

Warranty coverage does not include:

  • Acts of God
  • Power surges
  • Flooding
  • Fire
  • Improper maintenance
  • Neglect
  • Customer modifications
  • Damage caused by third parties

***Routine maintenance may be required to maintain manufacturer warranty eligibility.***


8. Existing Conditions

Comfort Matters is not responsible for pre-existing conditions including but not limited to:

  • Improper ductwork
  • Electrical deficiencies
  • Structural defects
  • Roofing issues
  • Plumbing issues
  • Mold
  • Water intrusion
  • Code violations not visible during inspection

***Additional repairs required to complete the project will be quoted separately.***


9. Refrigerant

Refrigerant is billed by the pound unless otherwise included in the proposal.

Comfort Matters complies with all EPA regulations regarding refrigerant handling and recovery.


10. Cancellation

Customers may cancel scheduled appointments by providing at least twenty-four (24) hours' notice. ***Special-order equipment may not be refundable once ordered.***


11. Limitation of Liability

To the fullest extent permitted by law, Comfort Matters shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from services performed.

***Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.***


12. Safety

Customers agree to maintain a safe work environment. Technicians may refuse service if unsafe conditions exist, including aggressive animals, hazardous materials, unsafe electrical conditions, or threatening behavior.


13. Communications

By requesting service, customers consent to receive communications by phone, email, and text message regarding:

  • Appointment reminders
  • Technician arrival notifications
  • Estimates
  • Invoices
  • Service updates
  • Maintenance reminders
  • Customer satisfaction surveys

***Customers may opt out of marketing communications at any time.***


14. Intellectual Property

All content on our website, including logos, photographs, graphics, documents, and text, is the property of Comfort Matters Air & Mechanical LLC and may not be copied without written permission.


15. Governing Law

These Terms shall be governed by the laws of the State of Florida.

Any disputes shall be resolved in the appropriate courts located within the State of Florida.


16. Changes

Comfort Matters reserves the right to update these Terms & Conditions at any time. Continued use of our services constitutes acceptance of any revisions.
